What is an Independant Administrative Authority ?

Independent of the controlled sectors and public authorities, it is not subject to any authority.

Administrative: acts "on behalf of the State" and certain powers devolved upon the administration are delegated to it (control, verification, authorization).

Authority: has its own specific powers (recommendations, decisions, regulatory proposals, sanctions).

The following are excluded from the jurisdiction of the APDP:

  • the processing operations carried out by courts and the Public Prosecutor's Office in the exercise of their judicial functions as well as those carried out in the context of international mutual legal assistance procedures;
  • the processing operations relating to State security and national security.

In fact, these processing operations respectively come under the jurisdiction of a Délégué judiciaire à la protection des données (Judicial delegate for data protection) and the Commission Spéciale de Sécurité Nationale (Special Commission for National Security) instituted by Article 16 of Law no. 1.430 of July 13, 2016, respectively.

 

Composition of the APDP

  • The Authority

The APDP is composed of 8 full members proposed because of their competence and appointed by Sovereign Ordinance for 5 years, renewable once:

  • a member proposed by the Minister of State;
  • a member proposed by the National Council ;
  • a member proposed by the Council of State;
  • a member who is a sitting judge, active or retired, who has served for a period of at least five years in a Monegasque jurisdiction, by the First President of the Court of Appeal;
  • a member proposed by the Town Council;
  • a member proposed by the Economic, Social, and Environmental Council;
  • a member who is a judge, active or retired, who has served for a period of at least five years in a Monegasque jurisdiction, by the First President of the Court of Revision;
  • a qualified member in the field of health appointed by the Public Health Committee.

The Authority elects a President and Vice-President from among its members.

The Members of the Authority were appointed by Sovereign Order n° 11.407 of July 21, 2025.

The President and Vice-President were elected on July 28, 2025 during the Authority’s first plenary session.

  • The Secretariat

The services of the APDP are directed by the President who is responsible for representing the State in court due to the activities and functioning of the Authority.

These services, which assist the Authority in the exercise of its mission, include the Secretary General and secretariat staff.

The Authority has its own budget, the appropriation of which is entered in a specific chapter of the State budget.

It establishes and publishes its rules of procedure on its website.
