{"id":21919,"date":"2026-07-23T14:02:29","date_gmt":"2026-07-23T12:02:29","guid":{"rendered":"https:\/\/apdp.mc\/?page_id=21919"},"modified":"2026-07-23T14:07:06","modified_gmt":"2026-07-23T12:07:06","slug":"requests-for-the-right-of-access","status":"publish","type":"page","link":"https:\/\/apdp.mc\/en\/individuals\/specific-practical-cases\/requests-for-the-right-of-access\/","title":{"rendered":"Requests for the right of access"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-size: 24px;\"><strong>Can I appoint someone else to act on my behalf to exercise my right of access?<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">Yes, any data subject may <strong>authorise<\/strong> a person of their choice (such as a legal adviser) to exercise their right of access <strong>on their behalf<\/strong> with a data controller.<\/p>\n<p style=\"text-align: justify;\">To do so, they must provide the person acting on their behalf with a letter stating the <strong>identity of the principal<\/strong> (the applicant), <strong>the purpose of the authorisation<\/strong> (the exercise of the right of access) and <strong>the identity of the authorised representative<\/strong> (the applicant\u2019s representative). This authorisation must also specify whether the authorised representative may be sent the data controller\u2019s response.<\/p>\n<p style=\"text-align: justify;\">The principal must also enclose a copy of their identity document with this letter. The authorised representative, for their part, must provide evidence of their authority to act on behalf of the principal.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 24px;\"><strong>Can I ask a data controller for access to the data they hold about my deceased spouse?<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">Yes, Article 20 of Law no. 1.565 of December 3, 2024 provides for a right of access to information concerning <strong>deceased persons<\/strong>. Subject to any contrary legislative or regulatory provisions, <strong>an ascendant, descendants up to the second degree, the surviving spouse<\/strong> of a deceased person, or <strong>a cohabiting partner or partner<\/strong> within the meaning of Law no. 1.481 of December 17, 2019 on civil solidarity contracts, may, provided <strong>they can demonstrate a legitimate interest<\/strong>, exercise the right of access to information concerning that person.<\/p>\n<p style=\"text-align: justify;\">In addition to proving your identity, you must provide <strong>evidence of your relationship with the deceased by any means<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Can I appoint someone else to act on my behalf to exercise my right of access?
