{"id":20698,"date":"2025-01-16T17:40:21","date_gmt":"2025-01-16T16:40:21","guid":{"rendered":"https:\/\/apdp-mc-stage.jupiter.cdigital.fr\/?page_id=20698"},"modified":"2025-09-23T14:39:15","modified_gmt":"2025-09-23T12:39:15","slug":"deliberations","status":"publish","type":"page","link":"https:\/\/apdp.mc\/en\/apdp\/ruling\/deliberations\/","title":{"rendered":"Deliberations"},"content":{"rendered":"<p style=\"text-align: justify;\">The APDP issues a <strong>reasoned opinion<\/strong> on three categories of processing that <strong>are particularly sensitive<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The Authority is moreover <strong>consulted for an opinion<\/strong>:<\/p>\n<ul style=\"text-align: justify;\">\n<li>by the <strong>Minister of State<\/strong> or by the <strong>Secretary of State of Justice<\/strong>, Director of Judicial Services during the drafting of legislative or regulatory <strong>measures or directorial orders in the context of the administration of justice<\/strong> relating to the protection of personal data, as well as on all measures relating to data protection;<\/li>\n<li>by the <strong>President of the National Council<\/strong> when studying <strong>proposals or bills <\/strong>relating to data protection or the processing of such data.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The APDP also<strong> gives prior authorization for data transfers<\/strong> to a State, territory or international organization that <strong>does not ensure an adequate level of protection<\/strong> when:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>appropriate safeguards have not been put in place<\/strong>, and<\/li>\n<li><strong>none of the derogations provided<\/strong> for in section 99 of the Act apply, and<\/li>\n<li>the <strong>4 conditions set out<\/strong> in section 3 of article 99 are not met.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Finally, it adopts <strong>recommendations designed to facilitate the application of the rules laid down in the Law.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The APDP issues a reasoned opinion on three categories of processing that are particularly sensitive.
