What is an Independant Administrative Authority\u00a0?<\/strong><\/td>\n<\/tr>\n
\n

Independent<\/strong> of the controlled sectors and public authorities, it is not subject to any authority.<\/p>\n

Administrative<\/strong>: acts “on behalf of the State” and certain powers devolved upon the administration are delegated to it (control, verification, authorization).<\/p>\n

Authority<\/strong>: has its own specific powers (recommendations, decisions, regulatory proposals, sanctions).<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

The following are excluded from the jurisdiction of the APDP:<\/p>\n

    \n
  • the processing operations carried out by courts and the Public Prosecutor’s Office<\/strong> in the exercise of their judicial functions as well as those carried out in the context of international mutual legal assistance procedures<\/strong>;<\/li>\n
  • the processing operations relating to State security and national security.<\/strong><\/li>\n<\/ul>\n

    In fact, these processing operations respectively come under the jurisdiction of a D\u00e9l\u00e9gu\u00e9 judiciaire \u00e0 la protection des donn\u00e9es<\/strong> (Judicial delegate for data protection<\/strong>) and the Commission Sp\u00e9ciale de S\u00e9curit\u00e9 Nationale<\/strong> (Special Commission for National Security<\/strong>) instituted by Article 16 of Law no. 1.430 of July 13, 2016, respectively.<\/p>\n

    Composition of the APDP<\/strong><\/p>\n

      \n
    • The Authority<\/em><\/li>\n<\/ul>\n

      The APDP is composed of 8 full members<\/strong> proposed because of their competence and appointed by Sovereign Ordinance for 5 years, renewable once<\/strong>:<\/p>\n

        \n
      • a member proposed by the Minister of State<\/strong>;<\/li>\n
      • a member proposed by the National Council<\/strong> ;<\/li>\n
      • a member proposed by the Council of State<\/strong>;<\/li>\n
      • a member who is a sitting judge<\/strong>, active or retired, who has served for a period of at least five years in a Monegasque jurisdiction, by the First President of the Court of Appeal<\/strong>;<\/li>\n
      • a member proposed by the Town Council<\/strong>;<\/li>\n
      • a member proposed by the Economic, Social, and Environmental Council<\/strong>;<\/li>\n
      • a member who is a judge, active or retired, who has served for a period of at least five years in a Monegasque jurisdiction<\/strong>, by the First President of the Court of Revision<\/strong>;<\/li>\n
      • a qualified<\/strong> member in the field of health appointed by the Public Health Committee<\/strong>.<\/li>\n<\/ul>\n

        The Authority elects a President and Vice-President from among its members.<\/p>\n\n\n\n
        \n

        Current composition of the APDP<\/strong><\/p>\n

        The Members of the Authority were appointed by Sovereign Order n\u00b0 11.407 of July 21, 2025.<\/em><\/p>\n

        The President and Vice-President were elected on July 28, 2025 during the Authority\u2019s first plenary session<\/em>.<\/p>\n

          The services of the APDP are directed by the President who is responsible for representing the State in court<\/strong> due to the activities and functioning of the Authority.<\/p>\n

          These services, which assist the Authority in the exercise of its mission, include the Secretary General and secretariat staff<\/strong>.<\/p>\n

          The Authority has its own budget, the appropriation of which is entered in a specific chapter of the State budget.<\/p>\n

          It establishes and publishes its rules of procedure on its website.<\/p>\n\n\n\n
