{"id":20329,"date":"2025-01-16T12:04:50","date_gmt":"2025-01-16T11:04:50","guid":{"rendered":"https:\/\/apdp-mc-stage.jupiter.cdigital.fr\/?page_id=20329"},"modified":"2025-10-29T10:39:34","modified_gmt":"2025-10-29T09:39:34","slug":"video-surveillance","status":"publish","type":"page","link":"https:\/\/apdp.mc\/en\/individuals\/specific-practical-cases\/video-surveillance\/","title":{"rendered":"Video surveillance"},"content":{"rendered":"<h2 style=\"text-align: justify;\"><strong>Can I install cameras in my flat?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Yes, provided that certain rules are followed.<\/p>\n<p style=\"text-align: justify;\">Many individuals are increasingly turning to surveillance systems to protect themselves, for example, against burglaries.<\/p>\n<p style=\"text-align: justify;\">While the use of such systems is not problematic in itself, resorting to them in the presence of domestic staff (butler, nanny, housekeeper&#8230;) or regular service providers (home nurse, delivery person, plumber&#8230;) requires certain specific precautions.<\/p>\n<p style=\"text-align: justify;\">Indeed, when used indiscriminately, surveillance cameras can lead to <strong>abusive monitoring<\/strong> of the data subjects, thereby infringing on their privacy.<\/p>\n<p style=\"text-align: justify;\">Thus, if the APDP authorizes the use of cameras for <strong>security purposes<\/strong>, it prohibits their use when these:<\/p>\n<ul style=\"text-align: justify;\">\n<li>are used to monitor the work or working hours of an employee;<\/li>\n<li>lead to a permanent and inappropriate control of the data subjects.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The Article 85 of Law No. 1,565 of December 3, 2024 further stipulates that surveillance systems installed in private homes must be promptly <strong>brought to the attention of the APDP<\/strong> whenever <strong>people from outside the family or friendship circle enter the home<\/strong> (e.g., domestic staff, home helpers).<\/p>\n<p style=\"text-align: justify;\">The APDP also request that all concerned persons be <strong>informed in advance<\/strong> of the presence of cameras, for example through a mention in the employees\u2019 employment contract, or through a notice on the door for occasional service providers.<\/p>\n<p style=\"text-align: justify;\">Finally, the installation of cameras must be carried out in such a way that they only film private areas, paying particular attention to ensuring that neighbors (through windows, large glass doors\u2026) are not exposed to video surveillance.<\/p>\n<p style=\"text-align: justify;\"><strong>To learn more<\/strong>:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Factsheet <a href=\"https:\/\/apdp.mc\/en\/apdp\/fact-sheets\/surveillance\/video-surveillance-of-private-homes\/\" target=\"_blank\" rel=\"noopener\"><strong>Video surveillance of private homes<\/strong><\/a><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>One of the cameras installed in my apartment building films the entrance of my flat.
