{"id":20324,"date":"2025-01-16T12:00:10","date_gmt":"2025-01-16T11:00:10","guid":{"rendered":"https:\/\/apdp-mc-stage.jupiter.cdigital.fr\/?page_id=20324"},"modified":"2025-10-29T10:28:51","modified_gmt":"2025-10-29T09:28:51","slug":"human-resources","status":"publish","type":"page","link":"https:\/\/apdp.mc\/en\/individuals\/specific-practical-cases\/human-resources\/","title":{"rendered":"Human resources"},"content":{"rendered":"<h2 style=\"text-align: justify;\"><strong>Can I ask my employer to have access to the information contained in my HR file?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Yes.<\/p>\n<p style=\"text-align: justify;\">In accordance with Article 12 of Law No. 1.565 of December 3, 2024, <strong>any individual<\/strong> who so requests has the right to obtain confirmation that data <strong>concerning him or her<\/strong> are being collected and processed and can obtain the <strong>communication of said data<\/strong>.<\/p>\n<p style=\"text-align: justify;\">An employee can therefore contact his or her employer to access the information held about him or her by the Human Resources Department.<\/p>\n<p style=\"text-align: justify;\">However, this right of access is limited by the <strong>respect for the rights of third parties<\/strong>. A person can <strong>only access the data concerning him or herself<\/strong> and will not be able to obtain information about a co-worker.<\/p>\n<p style=\"text-align: justify;\">The right of access must not undermine <strong>trade secrets<\/strong> or <strong>intellectual property<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>To learn more<\/strong>:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Factsheet <a href=\"https:\/\/apdp.mc\/en\/apdp\/fact-sheets\/all-you-need-to-know-about-the-law\/the-rights-of-the-data-subjects-with-regard-to-their-personal-data\/\" target=\"_blank\" rel=\"noopener\"><strong>The rights of data subjects with regard to their personal data<\/strong><\/a><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Can my employer ask me for details about my health?<\/strong><\/h2>\n<p style=\"text-align: justify;\">No, this information is part of the \u00ab <em><strong>sensitive data<\/strong><\/em> \u00bb, defined in Article 2 of Law No. 1.565 of December 3, 2024, as personal data which <strong>directly or indirectly<\/strong> reveal political opinions or affiliations, racial or ethnic origins, religious or philosophical beliefs, union membership, or genetic data, biometric data for uniquely identifying a natural person, or data concerning the health, sexual life, or sexual orientation of a natural person.<\/p>\n<p style=\"text-align: justify;\">The collection and processing of such data are, except for exceptions, <strong>prohibited<\/strong> and constitute a <strong>criminal offense<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Your employer will only be informed within the framework of occupational medicine if you are <strong>fit for your job, fit with restrictions, or unfit<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Furthermore, in the event of sick leave, your employer is not informed of the reason.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Can I refuse to have my photograph in my company&#8217;s trombinoscope?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Yes, everyone has an absolute right over their image and the use that can be made of it.<\/p>\n<p style=\"text-align: justify;\">Thus, as long as the publication of an employee&#8217;s photo does not fall within the company&#8217;s obligations regarding the administrative management of employees (directory, internal directory, social networks, etc.), the employer must obtain the <strong>express consent of the data subject<\/strong> regarding the use of his or her photograph prior to its publication.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Can my employer request a detailed record of the calls I&#8217;ve made from my work phone?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Yes, an employer can request a detailed statement including all the called numbers <strong>but only in two specific cases<\/strong>:<\/p>\n<ul>\n<li style=\"text-align: justify;\">when the employer asks the employee to reimburse the expenses related to the private use of the company&#8217;s fixed or mobile telephone service, <strong>if the employee disputes the said amount<\/strong>;<\/li>\n<li style=\"text-align: justify;\">when the employer observes a clearly abusive use of the fixed or mobile telephone service by the employee in relation to the average usage observed for this type of service within the company, <strong>provided that the telephone statement is established in the presence of the employee<\/strong>.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Indeed, the issuance of such a phone record should not allow the surveillance of correspondents who are specifically identified and called by the employee, <strong>beyond the mere observation of the private nature of the communication<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Apart from these two cases, <strong>the last four digits of the called number must be hidden<\/strong> when issuing detailed statements.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Can I ask my employer to have access to the information contained in my HR file?
